1. Overview of Raffle
Sony Music Entertainment Germany GmbH, Bülowstraße 80, 10783 Berlin (hereinafter referred to as “Sony Music”) is holding a raffle to win a New York Trip to the Purple Disco Machine (hereinafter referred to as “PDM”) “CLUB Set” concert at “The Brooklyn Mirage” on September 24th, 2023. Entering this raffle is free of charge, but participants must sign up for the Purple Disco Machine Newsletter and enter their data HERE .
The possibility to enter the raffle closes on August 15th, 2023 at 11:59 pm/23:59 (UTC+2 / Berlin time).
2. Participation
Participation in the competition is only possible after the participant accepts these conditions of participation. By participating in the competition, the participant accepts these conditions of participation as well as the general conditions of participation, which also apply.
The organizer reserves the right to exclude multiple participations (e.g. under several names, accounts or email addresses) or in this respect conspicuous submissions or rather mass submissions. Persons, who (try to) get an advantage for their selves using unauthorized aids or technical manipulations are also excluded.
3. Eligibility
Only natural persons who are at least 21 years old at the time of participation with their permanent residence in Germany are eligible to participate. Each participant may only take part in their name and with complete and truthful information about the information requested.
4. Procedure
Eligible persons can enter the raffle only via this LINK. To participate they must sign up for the Purple Disco Machine Newsletter and submit the requested personal information. The entry is only complete and valid after submission of all mandatorily requested information and acceptance of all mandatory checkboxes and terms.
The winner will be drawn at random, contacted by email from Sony Music within three days of the end of the competition. The content of this message is all the information required to process the prize. Sony Music assumes no liability if, for reasons for which it is not responsible, the notification of the prize is lost during electronic transmission and/or does not reach the winner. If the winner does not respond within 2 (two) days and accepts the prize in writing, the winner loses all rights to the prize. A win that is not confirmed will not be awarded.
After successful acceptance of the prize, winner has 5 (five) business days to provide Sony Music confirmation of a valid ESTA authorization for the period of travel or other valid form of a visa allowing them entry into the United States for them and their accompanying person. If winner fails to provide confirmation of a valid ESTA authorization or other form of visa, the winner loses all rights to the prize and a new winner will be drawn.
5. Prize
The raffle prize is one trip to New York City (USA) from September 22nd-25th, 2023 to visit PDMs concert at “The Brooklyn Mirage” on September 24th, 2023, for one winner and an accompanying person of their choice. Additional to the eligibility clause and its age restrictions, the accompanying person must be at least 21 years old at the time of travel.
The prize is not transferable. The decision is final. It is not possible to pay out the prize in cash.
5.1 Travel
Sony Music will provide the flights from one of three German airports (Frankfurt am Main, Munich or Berlin) to New York City and return. Sony Music will cover the transfer from a New York City Airport to the Hotel and the return from the Hotel to a New York City Airport. The transport to and from the airport within Germany must be arranged and paid for by the winner. Sony Music will not cover any other traveling costs than stated above.
5.2 Accommodation
Sony Music will provide accommodation for the winner and their accompanying person in a hotel in New York City of Sony Music’s choice. All other expenses at the hotel must be paid by the winner and won’t be covered by Sony Music. The hotel will have a minimum 3 (three) Star standard and will be chosen, booked, and paid for by Sony Music. The stay will include three nights from September 22nd-25th in a double room and encompass breakfast at the hotel.
5.3 Show
The winner and accompanying person will be on the guest list for PDMs show on September 24th, 2023 at “The Brooklyn Mirage” for PDMs “CLUB SET”. There will be no access to any earlier sets played by PDM.
5.4 Food and other Costs
No other costs, other than the previously described breakfast at the hotel will be covered by Sony Music. All additional expenses must be covered by the winner.
6. VISA/ESTA & Border Entry
The winner and accompanying person must provide a legally valid visa or ESTA authorization for the US and by entering the raffle declare that they’re not listed on any no-fly-list or similar. The winner and accompanying person are solely responsible for providing and presenting all necessary documents, including international passports and visa documents and authorizations to travel to and from the US.
Sony Music does not cover any ESTA application/visa and border entry associated costs and does and will not provide support in applying for documents related to this raffle. It is the sole responsibility of the winner and accompanying person.
If they fail to show the visa/ESTA authorization and passport or are denied entry, no matter the reason, returns and all associated costs will not be planned or covered by Sony Music. If for whatever reason, the winner and accompanying person cannot enter the United States, they will have to cover all associated costs by themselves.
Immigration, customs, and entry to the US are in no sphere of influence of Sony Music and therefore are solely on the risk of the winner and accompanying person.
7. End of competition
Sony Music reserves the right to end the competition at any time. This applies in particular if, due to technical reasons (e.g. due to manipulation of the competition), proper implementation cannot be guaranteed.
8. Restrictions
Employees of Sony Music Entertainment Germany GmbH and their relatives are excluded from participation. Participation must be carried out in person. Employees of the agencies commissioned for this competition, as well as employees of the companies involved, are also excluded from participation. Participation in the competition by third parties, in particular third parties who register individual persons commercially with various teleservice providers (registration services or entry services), is not permitted.
9. Data Privacy
For the realization of the prize personal data like full names, date of birth, country of permanent residence, and email addresses will be collected. The participant is therefore responsible for the correctness of given contact data.
The given data from the participants are collected in accordance with the privacy policy. The privacy policy of the organizer can be reviewed at https://www.sonymusic.de/privacy-policy. By participating in the action, participants have to explicitly acknowledge that they have read and accepted the privacy policy.
10. Communication of campaign
The campaign is communicated on a landing page via QR-Code in Berlin Clubs. The promotion is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, or any other platform it is advertised on. The contact person and responsible party in this sense is Sony Music Entertainment Germany GmbH.
11. Liability Disclaimer
In the provision and implementation of the prizes, the organizer excludes liability for slightly negligent breaches of duty, provided that these do not relate to essential contractual obligations, damages arising from injury to life, limb or health, or guarantees, or claims under the Product Liability Act are affected. The same applies to breaches of duty by the organizer’s vicarious agents.
12. Applicable Law
For this action, German law shall apply. The place of jurisdiction – insofar as permissible – for all disputes arising in connection with the promotion shall be Munich.
